Neel Choudhury is an attorney at Jackson Gilmour & Dobbs, PC, who practices in the Baton Rouge, Louisiana, office. His litigation practice is focused on environmental and commercial litigation, with extensive experience in litigating energy related issues. Mr. Choudhury has handled cases before state and federal trial and appellate courts and has practiced before the Federal Energy Regulatory Commission, the United States Patent and Trademark Office, and the United States Copyright Office. In addition to his litigation practice, Mr. Choudhury also handles general business transactional work. He is licensed to practice law in Louisiana and Texas and before the Southern District of Texas.
Practice Areas/Experience
Mr. Choudhury has experience in representing plaintiffs and defendants in a wide array of environmental, commercial, and personal litigation matters, including natural gas market manipulation, business torts, contract disputes, employment actions, collection work, ERISA, intellectual property disputes, pre-arbitration disputes under the FAA and TAA, Texas Securities Act violations, Uniform Enforcement of Foreign Judgment Act filings, factoring fraud, negligence, product liability, and inverse condemnation proceedings. Some of his representative experience includes:
- Representing the State of Louisiana and the Louisiana Oil Spill Coordinator's Office in connection with its claim for natural resource assessment costs and damages in the Deepwater Horizon oil spill litigation;
- Represented a major natural gas producer in a lawsuit against a publicly traded pipeline company in Texas state court and before the Federal Energy Regulatory Commission on claims of natural gas market manipulation, fraud, breach of contract, breach of the UCC duty to reasonably market, price unavailability pursuant to a contractual price re-opener, unjust enrichment, state law anti-trust violations, and negligent misrepresentation, ultimately resulting in a multimillion dollar settlement;
- Defended an international rig assembly and service company against foreign claims of tortious interference, fraud, and business disparagement stemming from his client's role in an attempted reverse merger with a foreign national/private chain, resulting in the English company's case being non-suited;
- Represented a commercial landlord in a lawsuit against a major restaurant tenant that had terminated its lease early pursuant to a sole discretion clause, surviving the restaurant's motion for summary judgment and ultimately obtaining a favorable settlement for his client;
- Represented a regional apartment locating company in a federal court lawsuit against a former employee for copyright infringement, misappropriation of trade secrets, trade dress infringement, and breach of a contractual non-disclosure clause, resulting in a favorable settlement; and
- Represented a commercial real estate management firm in an action to enforce an unexecuted judgment and successfully recovered more than one million dollars in proceeds for the firm.
Mr. Choudhury also has experience representing his clients in general business transactional work, including entity formation, security issues, contract negotiation, drafting, review, and copyright and trademark filings. Some of his representative experience includes:
- Drafting an LLC Company Agreement, Non-Disclosure Agreement, and Non-Compete Agreement for a technology start-up company;
- Drafting a multi-million dollar marketing contract between two apartment locating companies;
- Drafting an Employer/Employee Dispute Resolution Program for an oil and gas service company with over 100 employees;
- Filing for copyrights and trademarks with the United States Copyright Office and the United States Patent and Trademark Office;
- Filing UCC statements and advising clients on creditor priority in bankruptcy; and
- Drafting several joint venture and limited partnership agreements.
Professional Background
Prior to joining the firm, Mr. Choudhury practiced law at the commercial litigation boutique Binion & Sims, PC, and its successor Parrott, Sims, and McInnis. Before working at Binion & Sims, Mr. Choudhury worked as a tax attorney, utilizing his knowledge of the Research and Development Tax Credit to help launch a specialized tax company. While in law school, Mr. Choudhury served as a judicial intern to the Honorable Bankruptcy Judge Jeff Bohm of the Southern District of Texas and as law clerk at Abraham, Watkins, Nichols, Sorrels, Agosto & Friend.
Mr. Choudhury received his law degree from the University of Houston in 2006. During that time, he served on the Executive Board of the Houston Business and Tax Law Journal and as President of the American Constitution Society. Mr. Choudhury also participated in the University of Baltimore School of Law program in Willemstad, Curacao.
Mr. Choudhury received his Bachelor of Arts in Information Systems and Decisional Sciences from Louisiana State University in 2002. During college, he also worked as a personal care assistant to disabled children, a computer network intern for a local technology engineering company, and as a web designer for Law Enforcement Online. He also participated in the University of New Orleans Study Abroad Program at the University of Innsbruck in Austria.
